Terms & Conditions

Article 1: Purpose

The purpose of these general terms and conditions of sale (GTCS) is :

  • To inform any potential consumer of the terms and conditions under which the seller proceeds with the sale and delivery of the products ordered.
  • To define the rights and obligations of the parties in connection with the sale of products by Vêtements Pros, products offered on the Vêtements Pros website, apiculture-france.fr.

Consequently, the act of ordering a product offered for sale on the Vêtements Pros website implies full acceptance of these terms and conditions of sale, which the buyer acknowledges having read prior to ordering.

The products are offered for sale in the following geographical territory: Metropolitan France.

Vêtements Pros reserves the right to modify these terms and conditions of sale at any time.

Article 3: Contract formation and orders

The sale prices of products on the www.apiculture-france.fr website, indicated in Euros, are those in force at the time of dispatch of the quotation to the customer.

They do not include shipping costs (unless otherwise stated), which are invoiced in addition to the price of the products purchased, depending on the amount of the order.

Prices include value added tax (VAT) applicable on the day of the order and any change in the applicable VAT rate will be automatically reflected in the price of products sold by Vêtements Pros.

Product prices may be modified by www.apiculture-france.fr at any time. Customers will be informed of any such changes before placing an order.

In accordance with article L111-1 of the French Consumer Code, the buyer may, prior to placing an order, review the essential characteristics of the product(s) he/she wishes to order on the www.apiculture-france.fr website.

Any order implies unreserved acceptance of these terms and conditions of sale.

The Buyer’s order must be confirmed by www.apiculture-france.fr by e-mail.

The sale will not be considered final until www.apiculture-france.fr has sent the Buyer the invoice for the order and has received payment in full.

Article 4: Method of payment

All orders are payable in Euros.

To pay for his order, the Buyer has all the means of payment indicated on the site.

Insofar as modifications requested by the customer during the course of the project imply a substantial change to the project, these modifications may be invoiced.

Article 5: Delivery and acceptance

Products will be delivered to the address indicated by the Buyer on the order form.

The Buyer may, at his request, have the invoice sent to the billing address and not to the delivery address, by indicating this when validating the quotation.

Apiculture-France.fr offers its customers delivery by colissimo and relais colissimo.

These delivery times are given as an indication only. Any delay in delivery shall not give rise to damages, withholding or cancellation of the order by the Buyer.

In the event of delivery of a product that does not correspond to the order (defective or non-compliant), and in accordance with current legislation, consumers have a period of 7 days from the date of receipt of the package to request an exchange or refund.

In order to exercise this right, it is up to the Buyer to return (at his/her own expense) the parcel to the address of the company’s head office indicated in paragraph 2, accompanied by a letter requesting either reimbursement or exchange of the product.

Failing this, Apiculture-France.fr will not exchange or reimburse products ordered in this way.

Article 6: Right of withdrawal

In accordance with article L121-16 of the French Consumer Code, the Buyer has a period of seven clear days from the date of receipt to return the products ordered for reimbursement, at his or her own expense.

Any product that is incomplete, damaged or whose original packaging has been damaged will not be refunded or exchanged.

The exercise of the right of withdrawal will give rise, at the purchaser’s choice, either to a cash refund or to the allocation of a purchase voucher.

Article 7: Product warranty

Our products benefit from the guarantee against hidden defects defined by the French Civil Code, as well as the guarantee of good conformity imposed by article L211-5 of the French Consumer Code, which are always applicable to them. In order to exercise this right, and except for specific provisions to the contrary for certain products, detailed at the time of purchase of the good, it is advisable to contact customer service, under the conditions defined above. No returns will be accepted without prior authorization from www.apiculture-France.fr.

We accept no liability for any other use of the products or failure to observe the warning instructions on the product labels and information leaflets. The warranty applies only after agreement with the manufacturer and inspection of the product. Return shipping costs are at the customer’s expense. APIPROTEC is responsible for any repairs carried out after management approval. This warranty applies only to products purchased on our website www.apiculture-france.fr. This warranty does not apply to our distributors.

Article 8: Non-waiver

The fact that one of the parties does not avail itself of a breach by the other party of any of the obligations referred to in these terms and conditions of sale shall not be construed as a waiver of the obligation in question for the future.

Article 9: Distribution contract

  1. Purpose of the contract

The purpose of this contract is to distribute Apiprotec and Hornetprotec brand products manufactured and supplied by the Supplier.

  1. Distributor definition

The Distributor, for the purposes of this contract, is defined as any person or entity purchasing Apiprotec and Hornetprotec brand products for the purpose of resale.

  1. Distributor’s obligations

The Distributor undertakes to :

  1. Promote and sell Apiprotec and Hornetprotec brand products in the territory defined by the Supplier.
  2. Do not resell the products to other distributors without the Supplier’s prior written authorization.
  3. Comply with the Supplier’s pricing policies and marketing guidelines.
  4. Prohibition on resale to other distributors

The Distributor is expressly prohibited from reselling Apiprotec and Hornetprotec brand products to other distributors. Any request for resale to another distributor must be submitted in writing to the Supplier, who reserves the right to accept or refuse it at its sole discretion.

  1. Duration and renewal

This contract is concluded for a period of 5 years from the date of signature. It will be tacitly renewable for successive periods of 3 years, unless terminated by either party by registered letter with acknowledgement of receipt, sent at least 3 months before the expiry date.

  1. Cancellation

The present contract may be terminated automatically by either party in the event of a serious breach by the other party of one of its contractual obligations, after formal notice has remained without effect for a period of 30 days.

  1. Privacy

The Distributor undertakes to keep strictly confidential all information, documentation and trade secrets to which it may have access in the performance of the present contract.

  1. Non-exclusive

The Supplier reserves the right to appoint other distributors for Apiprotec and Hornetprotec brand products, and this contract does not confer any right of exclusivity on the Distributor.

  1. Applicable law and jurisdiction

This contract is subject to French law. It will be interpreted and executed in accordance with this law, regardless of conflict of laws rules. In the event of a dispute relating to the performance or interpretation of this contract, the parties agree to seek an amicable solution. In the absence of an amicable solution, the dispute will fall within the exclusive jurisdiction of the courts of Reims, even in the event of multiple defendants or the introduction of third parties, and this for all international disputes.

Article 10: Partial non-validation

If one or more stipulations of these terms and conditions are held to be invalid or declared as such in application of a law, regulation or following a final decision by a competent court, the other stipulations will retain their full force and scope.

Article 11: Applicable law and jurisdiction

These terms and conditions are governed by French law. In the event of a dispute or claim, the buyer should first contact Vêtements Pros for an amicable solution.

In the absence of amicable agreement, the dispute will be submitted to the French courts. Jurisdiction is attributed to the competent courts of Reims, notwithstanding multiple defendants or the introduction of third parties.

Article 12: Legal information

French Data Protection Act:
In accordance with the French Data Protection Act of January 6, 1978, you have the right to access, rectify and object to any personal data concerning you. To do so, simply send us a request online or by post, stating your full name and address.
